It can be a significant 15% of the purchase price.<\/div>\n<div data-block-id=\"block-d7e89f91-2328-4d61-9852-af2ce5909472\">\u00a0<\/div>\n<div class=\"ql-block\" data-block-id=\"block-00ffb864-ba9d-41f6-9e91-12e912f897e3\">Don\u2019t worry there are ways to reduce this withholding tax and in some circumstance be exempt from it.<\/div>\n<\/div>\n<\/div><\/div>\n<\/div>\n<h2 class=\"ql-heading\" data-block-id=\"block-c4a4e0a9-2df9-4032-a0e8-8e4b2cd60b74\"><strong>What is the FIRPTA withholding rate?<\/strong><\/h2>\n<div class=\"ql-block\" data-block-id=\"block-cf50d6f9-f46b-4fd7-b4db-3ad328fa7e5b\">With few exceptions, the purchaser is required to withhold and pay a tax of up to 15% of the total selling price to the Internal Revenue Service (IRS) on the seller&#8217;s behalf. A 10% withholding rate applies when the purchase price is between US$300,000 and US$1 million.<\/div>\n<div class=\"ql-block\" data-block-id=\"block-cffb596f-5082-46a9-894e-ebee1eb6778c\">\u00a0<\/div>\n<div class=\"ql-block\" data-block-id=\"block-38f0cc9a-e472-4ddc-98f9-5f5bc3aa3be1\">Generally, <strong>no FIRPTA withholding<\/strong> is required if<\/div>\n<div data-block-id=\"block-38f0cc9a-e472-4ddc-98f9-5f5bc3aa3be1\">\u00a0<\/div>\n<ul>\n<li>the sales price is less than US$300,000;<\/li>\n<li>the purchaser\u00a0plans to\u00a0<a class=\"ql-link\" href=\"https:\/\/www.irs.gov\/individuals\/international-taxpayers\/exceptions-from-firpta-withholding\" target=\"_blank\" rel=\"noopener noreferrer\">use the property as a residence<\/a>; and<\/li>\n<li>the purchaser is an individual.<\/li>\n<\/ul>\n<div class=\"ql-block\" data-block-id=\"block-c11b632d-2e4d-40b6-812e-8d0559cfeb48\">\u00a0<\/div>\n<h2 class=\"ql-heading\" data-block-id=\"block-51f47d04-2b14-455b-a39e-751e8af2c786\"><strong>How does it work?<\/strong><\/h2>\n<div class=\"ql-block\" data-block-id=\"block-e345146c-5091-43da-9a3e-097271454ec3\">Once the transaction is complete the IRS places the responsibility of withholding on the buyer. The buyer will withhold up to 15% of the total sales price and give it to the IRS. Upon filing your US Income Tax Return in the following year, any money withheld will be used for the taxes owing from the sale.<\/div>\n<div class=\"ql-block\" data-block-id=\"block-f027ffab-fa21-4472-9186-8cd0300c0c83\">\u00a0<\/div>\n<div class=\"ql-block\" data-block-id=\"block-5e253e1f-a199-4640-a7eb-b1ead6502cd3\">The withholding tax can be viewed as an incentive to comply with your US tax reporting obligation truthfully and promptly so you, the seller, can recapture these funds.<\/div>\n<div class=\"ql-block\" data-block-id=\"block-3d7febc3-a01b-4cf7-860a-284dfe67b6d1\">\u00a0<\/div>\n<h2 class=\"ql-heading\" data-block-id=\"block-1d5a91ad-9203-48c8-a52a-38dafbac4ac9\"><strong>Rules for sellers if FIRPTA withholding is required:<\/strong><\/h2>\n<div class=\"ql-block\" data-block-id=\"block-a92695bf-7e6e-4792-913a-259b30aaeb51\">\u00a0<\/div>\n<h4 class=\"ql-heading\" data-block-id=\"block-824bcc29-2799-471a-9a2a-d1210b2c26e9\"><strong>To recover amounts withheld:<\/strong><\/h4>\n<div class=\"ql-block\" data-block-id=\"block-07e00f2f-981b-4198-a5c6-14a8133dbbb5\">File a US Income Tax Return using\u00a0<a class=\"ql-link\" href=\"https:\/\/www.irs.gov\/pub\/irs-pdf\/f1040nr.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Form 1040NR<\/a>\u00a0to\u00a0report the sale of the real estate and pay tax on any capital gains from the sale of the property.\u00a0When you file\u00a0<a class=\"ql-link\" href=\"https:\/\/www.irs.gov\/pub\/irs-pdf\/f1040nr.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Form 1040NR<\/a>\u00a0the withholding tax is used as a credit against any income tax owing from the sale. Any remaining amount will be returned.<\/div>\n<div class=\"ql-block\" data-block-id=\"block-af5e0a04-32ce-4fbb-9788-66734e0df30f\">\u00a0<\/div>\n<h4 class=\"ql-heading\" data-block-id=\"block-af33d07c-c6f2-4a73-9c61-3112badb26b5\"><strong>To reduced the FIRPTA withholding amount:<\/strong><\/h4>\n<div class=\"ql-block\" data-block-id=\"block-816394a7-b237-4ce9-8adb-e2c434ea15aa\">Apply to the IRS for a withholding certificate using\u00a0<a class=\"ql-link\" href=\"https:\/\/www.irs.gov\/pub\/irs-pdf\/f8288b.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Form 8288-B<\/a>\u00a0to reduce the withholding tax. You are eligible for the certificate if the total amount of income tax due is anticipated to be less than the withholding amount.\u00a0<a class=\"ql-link\" href=\"https:\/\/www.irs.gov\/pub\/irs-pdf\/f8288b.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Form 8288-B<\/a>\u00a0must be filed with the IRS prior to the date of sale and the buyer must be
